THIRD-PARTY USE OF PERSONAL INFORMATION

Additionally, we may share your information with “Service Providers,” which are defined as “a sole proprietorship, partnership, limited liability company, corporation, association, or other legal entity that is organized or operated for the profit or financial benefit of its shareholders or other owners, that process information on behalf of a business and to which the business discloses a consumer’s personal information for a business purpose pursuant to a written contract, provided that the contract prohibits the entity receiving the information from retaining, using or disclosing the personal information for any purposes other than for the specific purpose of performing the services specified in the contract for the business” or “retaining, using, or disclosing the personal information for a commercial purpose other than providing the services specified in the contract with the business.” 

The Websites may use third-party service providers to service various aspects of the Websites. Each third-party service provider’s use of your personal information is dictated by their respective privacy policies; however, we have entered an agreement with them that they will not use your information for any purpose other than the business purposes that are part of our agreement with them. The Websites currently uses the following third-party service providers: 

  • HubSpot – this service is used for delivery of email updates and newsletters. HubSpot stores your name and email address for purposes of delivering such communications. This service is also used to provide customer service to our clients. Your IP address, email address, and voluntarily entered information will be stored by Intercom on its servers.

  • Paypal – this service is used for payment processing on ecommerce products. At no time is your banking information passed to the Websites. We receive only information used for order fulfillment and reporting.

  • Stripe – this service is used for payment processing on ecommerce products. At no time is your banking information passed to the Websites. We receive only information used for order fulfillment and reporting.

  • Samcart – this service is used for our ecommerce products. Your personal information may be shared with us for purposes of order fulfillment, customer service, or reporting. You may automatically receive certain correspondence from us related to your order, but your purchase will not automatically add you to any marketing email lists.

  • Kajabi – this service is used to host our ecommerce products. Your personal information is used to create your account and communicate with you regarding the service.

  • Typeform – this service is used occasionally to capture information from our clients. All personal information is voluntarily input and is not required unless a client elects to submit the applicable form. Any information input into the form is saved by Typeform and is accessible to TMS staff.

  • Post Affiliate Pro – this service is used to allow us to service our affiliate programs, including products sold by our FASTer Way to Fat Loss Certified Coaches.

  • Salesmsg and EZ Text – these services are used to provide SMS communications to our clients

    • FASTer Way To Fat Loss offers different text messaging programs, depending on the products/services you purchase. These messages include marketing/product information, as well as account notifications, as indicated below:
      - 22166 FASTer Way Clients: Standard product marketing/promotional notifications, purchase alerts.
      - 44378 FASTer Way VIP: VIP product marketing/promotional notifications, purchase alerts.
      - 64837 FASTer Way Coaches: Coaching product marketing/promotional notifications, purchase alerts and billing reminders.

      54986 FASTer Way Marketing: marketing/promotional notifications.

    • You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

    • If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at https://www.fasterwaytofatloss.com/generalsupport.

    • Carriers are not liable for delayed or undelivered messages

    • As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.Leadpages – this service is used to create subscription pages. Leadpages captures information, which it automatically transfers to Active Campaign.

  • Vidapp – this service is used to host the FASTer Way mobile application. Your email address is shared with Vidapp to verify membership. 

  • Shopify - this service is used for our ecommerce products. Your personal information may be shared with us for purposes of order fulfillment, customer service, or reporting. You may automatically receive certain correspondence from us related to your order, but your purchase will not automatically add you to any marketing email lists. 

  • Merchandise Fulfillment – if you purchase a physical product from the Websites, your information may be forwarded to one of our merchandise fulfillment partners for the purpose of fulfilling your order. You may receive emails regarding shipping or fulfillment, but your purchase will not automatically add you to any marketing email lists.

At this time, your personal information is not shared with any other third-party applications. This list may be amended from time to time in the Websites’ sole discretion.

Except when required by law, Tress Marketing Solutions will not sell, distribute, or reveal your email addresses or other personal information without your consent; however, Tress Marketing Solutions may disclose or transfer personal information collected through the Websites to third parties who acquire all or a portion of our business, which may be the result of a merger, consolidation, or purchase of all or a portion of our assets, or in connection with any bankruptcy or reorganization proceeding brought by or against us.

Education Information

This includes: Information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act, which includes: records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, schedule, student identification codes, student financial information, or student disciplinary records.

WEBSITE ANALYTICS

The Websites use Google Analytics and Squarespace Analytics to analyze traffic to the Websites. 

In order to track usage, Google Analytics places a cookie with a randomly generated Client ID on your browser. Google does use your personal information such as your IP address in order to capture reporting for the Websites regarding usage. You may opt-out of Google Analytics through a Browser Add-on, which is available here

ANONYMOUS DATA

From time to time, Tress Marketing Solutions may use anonymous data, which does not identify you alone, or when combined with data from other parties. This type of anonymous data may be provided to other parties for marketing, advertising, or other uses. Examples of this anonymous data may include analytics or information collected from cookies.

COOKIES

The Websites use cookies to store visitors’ preferences, record user-specific information on what pages users access or visit, ensure that visitors are not repeatedly sent the same banner ads, customize content based on visitors’ browser type or other information that the visitor sends. Cookies may also be used by third-party services, such as Google Analytics, as described herein.

Users may, at any time, prevent the setting of cookies, by the Websites, by using a corresponding setting of your internet browser and may thus permanently deny the setting of cookies. Furthermore, already set cookies may be deleted at any time via an Internet browser or other software programs. This is possible in all popular Internet browsers. However, if users deactivate the setting of cookies in your Internet browser, not all functions of our Websites may be entirely usable.

ADVERTISING

Retargeting Ads
From time to time, the Websites may engage in remarketing efforts with third-party companies, such as Google, Pinterest, Facebook, or Instagram, in order to market the Websites. These companies use cookies to serve ads based on someone's past visits to the Websites. This means, after visiting the Websites, you may see an ad for our services. However, your personally identifiable information is not used by any remarketing service other than to present you offers from the Websites. We use the following third-party service providers for remarketing:

Newsletters
On the Websites, you may subscribe to our newsletter, which may be used for advertising purposes. All newsletters sent may contain tracking pixels. The pixel is embedded in emails and allows an analysis of the success of online marketing campaigns. Because of these tracking pixels, Tress Marketing Solutions may see if and when you open an email and which links within the email you click. Also, this allows Tress Marketing Solutions to adapt the content of future newsletters to the interests of the user. This behavior will not be passed on to third parties; however, it is accessible by our email service provider, HubSpot.

Affiliate Program Participation
The Websites may engage in affiliate marketing, which is done by embedding tracking links into the Websites. If you click on a link for an affiliate partnership, a cookie will be placed on your browser to track any sales for purposes of commissions.  

Tress Marketing Solutions, LLC. is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and links to Amazon.com.  As part of this Amazon Associates program, TMS will post customized links, provided by Amazon, to track the referrals to their website. This program utilizes cookies to track visits for the purposes of assigning commission on these sales.

RIGHTS RELATED TO YOUR PERSONAL INFORMATION FOR EUROPEAN UNION RESIDENTS

Opt-out – You may opt-out of future email communications by following the unsubscribe links in our emails. 

Access – You may access the personal information we have about you by submitting a request.

Amend – You may contact us to amend or update your personal information.

Forget – In certain situations, you may request that we erase or forget your personal data.

SENSITIVE PERSONAL INFORMATION

This includes your social security number, information regarding race or ethnic origin, political opinions, religious beliefs, health information, criminal background, or trade union memberships. If you elect to submit such information to us, it will be subject to this Privacy Policy.

CHILDREN'S INFORMATION

The Websites do not knowingly collect any personally identifiable information from children under the age of 16. If a parent or guardian believes that the Websites have personally identifiable information of a child under the age of 16 in its database, please contact us immediately at clientsuccess@fasterwaytofatloss.com and we will use our best efforts to promptly remove such information from our records.

CCPA - RIGHTS RELATED TO YOUR PERSONAL INFORMATION

As described above, your personal information may be shared with third-party vendors and service providers in order to fulfill purchased products or to communicate with you.
